Your spouse is watching two wave patterns on the monitor; one is the baby's heart-rate, the other is the contraction pattern from the outside of your uterus. Do you know what the tracings mean? Most likely, you don't.

The obstetrician and the obstetrical nurses are supposed to be watching those fetal tracings to make sure the baby is reacting properly every time you have a contraction. The external and internal fetal monitor are designed to detect whether the baby is in distress every time there is contraction. Problems can arise when there is a failure to timely recognize a baby who is in distress for an extended period of time.

Early detection and treatment is the key when it comes to treating patients with any type of cancer. A failure to diagnose can have devastating effects on you.

A mis-read mammogram; a failure to obtain a biopsy; improperly interpreted pathology slides; or a failure to listen carefully to a patient’s complaints, can all result in a death sentence for an unsuspecting patient.

If you have specific complaints that your doctor is not addressing then you should get a second medical opinion.

You don’t want to be sitting in an Attorney’s office kicking yourself wondering why you never went to another doctor when you kept complaining about a problem that your doctor simply did not deal with.

In this video I explain the arrogance of a doctor in a radio advertisement that I heard recently. Watch the video to learn what he said.

If a lawyer were to be so arrogant in their advertising not only would turn everyone off, but it would probably get him in trouble as well. Watch the video to learn why.

Disfiguring scars can be terribly embarrassing for the victim. They may be self-conscious about how they appear during the warm months of the year. Have you ever noticed someone at the beach who always wears long sleeve shirts or long pants? It may be that they have disfigurements somewhere on the body that they simply don't want others to see.

Disfiguring scars can be terribly embarrassing for the victim. They may be self-conscious about how they appear during the warm months of the year. Have you ever noticed someone at the beach who always wears long sleeve shirts or long pants? It may be that they have disfigurements somewhere on the body that they simply don’t want others to see.

Injured victims who suffer permanent scars often have lifelong reminders about their accident or medical care. These injuries are compensable. People may comment on the scars, and it may cause significant social discomfort. Watch the video to learn about one client I represented who had awful looking scars.

If you know someone who suffered significant injury or deformity, I encourage you to have them explore my website to learn more about how cases like these work in NY.
In this video testimonial, former client Rich Lakovits was kind enough to express his thoughts about what happened to his wife, how I was able to help them, and what he thought about my legal services.

Learn why knowing a client’s name makes all the difference.

Rich’s wife had received dental implants from a general dentist in New York. Only after the dentist abandoned her and all of his patients, they learned that the implants were put in totally incorrectly. These titanium implants would never be able to hold any type of tooth restoration or bridgework. This patient had to start over from scratch.

Today's video tip is gross. Truly. But there is an important reason why I'm talking to you about colostomies and a colostomy bag.

As a medical malpractice lawyer in New York, I encounter people who have had a colostomy after undergoing surgery where there has been some injury to the bowel.

If you don't know what a colostomy is, it's an opening from your belly that allows your fecal content to come out and be captured in a bag that must be changed frequently every day. This allows your intestines to heal. Once your intestines have healed, your surgeon can close the opening and your bowel can return to normal function.

If you’ve ever watched a trial on TV or in the movies, you know how compelling a strong opening argument is. The same applies in a real medical malpractice or wrongful death case here in New York.

A strong concise opening argument is needed to focus the jury on the key issues in the case and to explain the facts as favorably as possible.

There are many attorneys who lose the opportunity to capture a jury’s attention in the first few minutes of trial. Instead of discussing the case, they talk about how the lawsuit and trial process works. This wastes valuable time and opportunity to connect with the jury. Watch the video to learn more.

I was in court last week and had an opportunity to watch an experienced trial lawyer cross-examine an expert doctor on the witness stand in a gynecology malpractice case. I was shocked to see the worst cross examination ever in my 21 years of practice.

The attorney could barely formulate a question. He asked open-ended questions, allowing the expert to explain away most answers.

The lawyer violated every rule of cross examination and gave up total control of this witness. I actually felt bad sitting in court watching this spectacle. Watch the video to learn why.

In this brief video I give you an inside look at my Great Neck, New York office. (I also have satellite offices in New York City, Brooklyn and Staten Island, but wanted you to see where I spend most of my time). This is a never-before seen video of my office. You get to see where I spend most of my day when I’m in my office. In addition, I show you some of the lighting equipment I use to create my videos.

Come on in and take a look at my office.

Warning: It’s not some big fancy schmancy Manhattan law office with gorgeous furnishings, Persian rugs, expensive lamps or wood paneling. Rather, it’s a neat office that’s fully functional. Enough said. Watch the video to see for yourself.

When you bring a medical malpractice lawsuit in New York, you are required to have a medical expert confirm that you have a valid case. When you go to trial in a medical malpractice case in NY, you must also hire medical experts to explain to a jury what happened and why. Since we do not have medical training, the treatment that a patient may have received would not be within the common knowledge of the jurors, the attorneys or the judge who are listening to a case. In order to help us understand the medicine, we bring medical experts in, in different specialties, to talk about the reasons why a patient received particular care or lack of care.

Depending upon the type of case, we may bring in different medical experts to explain not just why there was wrongdoing, but also to explain how the wrongdoing caused injury. In addition, we are often required to bring in treating doctors to explain to the jury what problems this particular person will experience in the future and what further medical care and treatment this individual will need.

In an obstetrical malpractice case, we always bring in an obstetrician to talk about the wrongdoing. We also will bring in a pediatric neurologist to talk about the child and his or her injuries. In addition, we will often bring in physical and rehabilitation experts to talk about the child’s needs over the course of their lifetime based upon their disability. In a surgery malpractice case, obviously we bring in a surgeon; and value to diagnose lung cancer case we will often bring in a pulmonary expert as well as an oncologist, a doctor who specializes in treating cancer.

I received a call from woman who had three dental implants placed by a dentist in Queens, NY. The doctor had abandoned all of his patients due to a fire in one of his offices leaving her with unfinished dental work. She came to me, because no dentist wanted to continue doing the work that someone else had started. Unfortunately, she had no idea that the implants were not placed correctly. She had no idea that they were put in on an angle. She had no idea that the restoration would never fit correctly because of the improper placement of implants. Watch the video to learn why she came to me for legal help.

You undergo surgery and after leaving the hospital you have continued complaints of abdominal pain. Thinking it's normal, you ignore it for a day or two but it continues to get worse. You call your doctor's office and are told it is normal postoperative pain. Despite taking pain medication and resting, you get weaker, and your pain gets stronger. If you're lucky, you'll get to an emergency room to be evaluated.

When the doctors suspect that there is a hole in your bowel, you'll have to go back into surgery. If the contents of your bowel were leaking from a hole, you'll likely need to have part of your bowel removed and the remaining bowel sewn together.

The failure to recognize a bowel perforation is often grounds for a medical malpractice lawsuit in New York. If caught early enough, treatment can be effective although prolonged and distasteful. Those unlucky enough to get to a hospital on time, suffer the indignity of death from an unrecognized bowel perforation.

New York Daily News blows the lid on cover-ups at New York City municipal hospitals including Bellevue hospital, Coney Island hospital, Elmhurst hospital, Harlem hospital, Jacobi hospital, Kings County hospital, Lincoln hospital, Metropolitan hospital, North Central Bronx hospital, Queens General hospital and Woodhull hospital.

“City-run hospitals faked records and covered up dozens of botched operations, deadly accidents, malpractice and other medical screwups, a Daily News investigation has found.

The coverups hid a trail of human suffering among patients who were maimed and relatives who were never told the truth about how their loved ones died or were injured unnecessarily.”
