<p>A Westchester woman was awarded $1.5 million in a case involving improperly performed foot surgery. According to sources, she had a Lapidus bunionectomy performed in 2005 to her right foot. She claimed that during the procedure, too much bone had been removed from the first ray, specifically the medial cuneiform. In addition, she claimed that the first metatarasal was improperly positioned. As a result of improperly performed surgery, she claimed that the forces of her foot while weight-bearing shifted to the second and third metatarsals, causing pain, discomfort and irritation whenever she walked.</p>
<p>She had corrective surgery a year later to shorten the second and third metatarsals in an attempt to relieve the problem. Unfortunately, the surgery did not solve her problem. Conservative measures including the use of orthotics have failed. Her treating doctor has recommended that she undergo additional surgery to shorten those bones or that she undergo a destructive surgery which will destroy some of the joints in her foot and fuse those bones together.</p>
<p>The Westchester County jury, presided over by Justice Mary Smith, determined that the podiatrist departed from good and accepted podiatric and surgical care. This departure was a substantial factor in causing injury. jury determined that my client was entitled to receive $375,000 for past pain and suffering for the last five years. They also determined that she was entitled to receive $1,125,000 for future pain and suffering that would represent 30 years worth of future pain and suffering. The jury also awarded her husband $50,000 for his claim for loss of services.</p>

Sounds like the beginning  of a joke, right? Well, it&#8217;s not.</p>
<p>What he didn&#8217;t know until after the surgery was finished was that the  doctor cut his optic nerve and never realized it. The optic nerve was never supposed to be touched.</p>
<p>The optic nerve provides blood supply and nerve supply between the brain  and the eye. Cutting that nerve results in blindness. Watch the video  to learn more.</p>

What happened? The woman had complained of a lump in her breast and she was correctly referred for a mammogram. ]]></description>

<p>The mammogram results were interpreted as &#8220;normal&#8221; but her lump continue to grow. She was then referred to a breast surgeon for biopsy.</p>
<p>Unfortunately, the surgeon failed to biopsy the actual lump, and instead got surrounding tissue which was read as &#8220;normal.&#8221; He didn&#8217;t realize it at the time, but he missed the lump.</p>
<p>After being reassured by various doctors that she only had cystic breasts and there was no cancer, she gave no further thought to the mass in her breast. Finally, the mass became so pronounced that upon further evaluation, she learned that she had stage IV breast cancer.</p>
<p>When her treating doctors looked back at the original tests, they realized that there was evidence of cancer which was never detected or treated. Watch the video to find out what treatment she could have received which would have saved her life.</p>

The obstetrician and the obstetrical nurses are supposed to be watching those fetal tracings to make sure the baby is reacting properly every time you have a contraction. The external and internal fetal monitor are designed to detect whether the baby is in distress every time there is contraction. Problems can arise when there is a failure to timely recognize a baby who is in distress for an extended period of time.
