Watching TV we hear that the prosecutor has to prove their case beyond a reasonable doubt. However, in a medical malpractice or accident case in New York, that is not the standard that we must meet in order to prove that we are entitled to compensation. Instead, we need only show that we are more likely right than wrong that what we are saying is correct. This is known as the preponderance of credible evidence.

If the jury determines that we are more likely right than wrong, then the injured victim is entitled to be compensated for the harm that they have suffered.

A Westchester woman was awarded $1.5 million in a case involving improperly performed foot surgery. According to sources, she had a Lapidus bunionectomy performed in 2005 to her right foot. She claimed that during the procedure, too much bone had been removed from the first ray, specifically the medial cuneiform. In addition, she claimed that the first metatarasal was improperly positioned. As a result of improperly performed surgery, she claimed that the forces of her foot while weight-bearing shifted to the second and third metatarsals, causing pain, discomfort and irritation whenever she walked.

She had corrective surgery a year later to shorten the second and third metatarsals in an attempt to relieve the problem. Unfortunately, the surgery did not solve her problem. Conservative measures including the use of orthotics have failed. Her treating doctor has recommended that she undergo additional surgery to shorten those bones or that she undergo a destructive surgery which will destroy some of the joints in her foot and fuse those bones together.

The Westchester County jury, presided over by Justice Mary Smith, determined that the podiatrist departed from good and accepted podiatric and surgical care. This departure was a substantial factor in causing injury. jury determined that my client was entitled to receive $375,000 for past pain and suffering for the last five years. They also determined that she was entitled to receive $1,125,000 for future pain and suffering that would represent 30 years worth of future pain and suffering. The jury also awarded her husband $50,000 for his claim for loss of services.

A woman at a major Manhattan hospital kept making complaints to the young interns and residents who treated her in the New York city medical clinic. To their credit, they ordered the correct tests to evaluate her shortness of breath and wheezing. However, the young doctors-in-training failed to correctly interpret her clinical findings and the CT scans they had obtained. By the time she was diagnosed with stage IV lung cancer, it was too late to help her and she died from unrecognized and misdiagnosed widespread lung cancer.

A man goes into the hospital for eye surgery…
Sounds like the beginning of a joke, right? Well, it’s not.

What he didn’t know until after the surgery was finished was that the doctor cut his optic nerve and never realized it. The optic nerve was never supposed to be touched.

In this case, the doctor told the patient that she needed a hysterectomy to remove her uterus because she had invasive cervical cancer. After surgery, the pathology results revealed that this patient never had any type of invasive cancer. It turns out that the original Pap test was misread as well and the cone biopsy test was interpreted incorrectly as well. Watch the video to learn what happened.

In this video we learn how a doctor and hospital that failed to tell a patient she had a brain tumor cost them $1 million dollars.

The patient was in a car accident and was evaluated in a New York emergency room. A radiologist correctly interpreted her MRI and said there was a mass growing in her brain. Unfortunately for the patient, nobody bothered to tell her about this tumor.

Over the next six months, her vision in one eye deteriorated. Her eye doctor never bothered to check the original MRI from the emergency room, and never ordered another MRI until it was too late. Watch the video to find out what happened.

The mammogram results were interpreted as “normal” but her lump continue to grow. She was then referred to a breast surgeon for biopsy.

Unfortunately, the surgeon failed to biopsy the actual lump, and instead got surrounding tissue which was read as “normal.” He didn’t realize it at the time, but he missed the lump.

After being reassured by various doctors that she only had cystic breasts and there was no cancer, she gave no further thought to the mass in her breast. Finally, the mass became so pronounced that upon further evaluation, she learned that she had stage IV breast cancer.

When her treating doctors looked back at the original tests, they realized that there was evidence of cancer which was never detected or treated. Watch the video to find out what treatment she could have received which would have saved her life.

Your child complains of pain in their testicle. There was no trauma or accident. You look and don’t find anything wrong. Your child still complains. You give him a warm bath. He still has pain.

A woman from Brooklyn, New York had complained to her primary care doctor that she kept seeing traces of blood when she urinated. The doctor did a urinalysis on a few occasions but failed to recognize the significance of the results. He also failed to refer the patient to a urologist when she continued to complain of seeing blood in the bowl. When she was finally diagnosed, she had stage 4 bladder cancer which ultimately killed her.

I received a call from a woman the other day who just watched one of my videos. She claimed that her son’s case was identical to the one I talked about in my video. After listening to this woman, I quickly realized that her case was not the same and that I could not help her. “My case is the same!” She screeched.

You are walking down the street one summer day and notice someone in a tank top with horribly disfiguring scars. You think to yourself, “How could they have gotten such scars? Was it from an accident? Was it from surgery?” Are those scars so disfiguring that you are afraid to talk to that person?

Disfiguring scars can be terribly embarrassing for the victim. They may be self-conscious about how they appear during the warm months of the year.
