A woman from Brooklyn, New York had complained to her primary care doctor that she kept seeing traces of blood when she urinated. The doctor did a urinalysis on a few occasions but failed to recognize the significance of the results. He also failed to refer the patient to a urologist when she continued to complain of seeing blood in the bowl. When she was finally diagnosed, she had stage 4 bladder cancer which ultimately killed her.

Today’s video tip is gross. Truly. But there is an important reason why I’m talking to you about colostomies and a colostomy bag.

As a medical malpractice lawyer in New York, I encounter people who have had a colostomy  after undergoing surgery where there has been some injury to the bowel.

If you don’t know what a colostomy is, it’s an opening from your belly that allows your fecal content to come out and be captured in a bag that must be changed frequently every day. This allows your intestines to heal. Once your intestines have healed, your surgeon can close the opening and your bowel can return to normal function.

How many times have you heard the phrase “He walked into the hospital, but he came out dead?”

In this video, you will learn how a man with a kidney problem who was at high risk for developing a stroke was properly put on blood thinners. He then needed a surgical procedure and had to be taken off his blood thinners, otherwise he would bleed to death during the surgery.

The only problem was that nobody bothered to put him back onto his blood thinning medication following surgery.

I was in court last week and had an opportunity to watch an experienced trial lawyer cross-examine an expert doctor on the witness stand in a gynecology malpractice case. I was shocked to see the worst cross examination ever in my 21 years of practice.

The attorney could barely formulate a question. He asked open-ended questions, allowing the expert to explain away most answers.

I was in court last week and listened to a closing argument while waiting for case of mine to be called for conference. After 10 minutes of listening to the defense attorney in this podiatric malpractice case, I couldn’t figure out what he was talking about. When I went into the hall to speak to my adversary, I asked him what he thought of the defense attorney’s closing argument. He said the same thing I did.

When you bring a medical malpractice lawsuit in New York, you are required to have a medical expert confirm that you have a valid case. When you go to trial in a medical malpractice case in NY, you must also hire medical experts to explain to a jury what happened and why. Since we do not have medical training, the treatment that a patient may have received would not be within the common knowledge of the jurors, the attorneys or the judge who are listening to a case. In order to help us understand the medicine, we bring medical experts in, in different specialties, to talk about the reasons why a patient received particular care or lack of care.

In addition, we will often bring in physical and rehabilitation experts to talk about the child’s needs over the course of their lifetime based upon their disability. In a surgery malpractice case, obviously we bring in a surgeon; and value to diagnose lung cancer case we will often bring in a pulmonary expert as well as an oncologist, a doctor who specializes in treating cancer.

Knee Replacement Gone Bad; New York Medical Malpractice Lawyer Explains

A woman went to have a uni-compartmental knee replacement, and immediately upon waking from surgery was in extreme pain in the back of her knee. Despite the orthopedist’s reassurances that everything was fine, and that physical therapy would solve her problem, the pain continued for the next four months.

Follow-up x-rays revealed that the original hardware was not put in the correct position during the original surgery. As a result, this patient had to undergo corrective surgery to remove all of the hardware and then put in a total knee replacement to fix the problem.

You undergo surgery and after leaving the hospital you have continued complaints of abdominal pain. Thinking it’s normal, you ignore it for a day or two but it continues to get worse. You call your doctor’s office and are told it is normal postoperative pain. Despite taking pain medication and resting, you get weaker, and your pain gets stronger. If you’re lucky, you’ll get to an emergency room to be evaluated.

When the doctors suspect that there is a hole in your bowel, you’ll have to go back into surgery. If the contents of your bowel were leaking from a hole, you’ll likely need to have part of your bowel removed and the remaining bowel sewn together.

The failure to recognize a bowel perforation is often grounds for a medical malpractice lawsuit in New York. If caught early enough, treatment can be effective although prolonged and distasteful. Those unlucky enough to get to a hospital on time, suffer the indignity of death from an unrecognized bowel perforation.
