You walk into a house that has stairs leading up to the front door. One of the steps is not level and is uneven. You fall and fracture your leg. It turns out the person who built those stairs did not build them to proper code. Even though you may have thought your fall was caused by your own clumsiness, it actually turns out that the fault lies with the person who improperly constructed those stairs.

By the time you’ve gotten out of the hospital and returned home, the homeowner has already made repairs to the stairs.

When you ask the homeowner why he made the repairs, he tells you that he didn’t want anybody else to get hurt.

When you bring a lawsuit against the homeowner and the person who created those stairs, can you introduce evidence that the homeowner went ahead and fixed those steps immediately after he fell and broke your leg?

The fact that the homeowner recognized there was a problem with the steps and immediately fixed it after your injury, doesn’t that establish that he knew there was a problem with the stairs and only fixed it after your injury? Shouldn’t he be held responsible because he knew of the problem and hadn’t fixed it before?

Most lawyers typically will begin a deposition by asking about their credentials. However, I find it to be much more effective to instead get right to the heart of the case.

Within the first few questions I like to establish liability if possible.

How can you do that?

I recently questioned a dentist and it was our claim the dentist removed two permanent teeth rather than two baby teeth. As a result, this child will likely require implants.

“Doctor you removed two permanent teeth, correct?”
“Yes.”
“Your intention however was to remove this patient’s two baby teeth, correct?”
“Yes.”
“You would agree Doctor that extracting teeth that are not meant to be removed would be a departure from good and accepted dental care, correct?”
“Yes.”

Becoming board certified is achieved by demonstrating a certain baseline level of competency in a medical specialty. Board certification is the highest certification a doctor can achieve in their specialty.

If the doctor is not board certified, it could be for one of two reasons.

It could mean that they simply do not have the necessary level of competence and knowledge to pass the board certification examinations. Alternatively, it could mean that they have not yet taken their board examinations.

In order to first qualify to take the board certification tests, a doctor must complete a residency training program. Once they have completed their program, they must then accumulate two years worth of actual clinical practice and experience before being allowed to sit for their examinations.

In a medical malpractice case in New York, what is the first question that the jury is required to answer? “Did the defendant depart from good and accepted medical care?”

In other words, the question basically asks whether the defendant was negligent or careless. If the answer is yes, then they will proceed to the second question which is “Was the defendant’s negligence a substantial factor in causing the plaintiff’s (the injured victim) injuries?”

If the jury answers “No,” that will end the case unless there are other questions and other claims of liability. If the answer is “Yes,” the jury will then proceed to determine how much compensation to award to you.

Those were the first words the patient heard when he sat down in the eye doctor’s chair. The patient responded “What do you mean there is a hole in my eye? I was just in the emergency room two days ago and they told me I only had a scratched cornea!”

“I’m telling you you have a hole in your eye and you need surgery immediately,” said the eye doctor.
“How can I have surgery? I just ate breakfast this morning?” replied the patient.

This gentleman suffered an injury to his eye and went to a local emergency room here in New York. The physician’s assistant who examined him concluded that he only had a scratched cornea. She told him not to worry about it and if he has further problems to go to an eye doctor.

Two days later, when the pain became unbearable and tears from his eyes continued to flow, he saw an eye doctor. It turns out that the fluid coming from his eye was not tears, but was rather fluid from within his eyeball.

This is also known as a CPLR 3101(d) reply. Before trial, each side to a medical malpractice lawsuit in New York is required to notify the other side about which experts they have retained to testify at trial. Failure to notify the other side about a particular expert will likely result in you not being able to put on that expert to testify.

In New York, there are specific rules about what must be exchanged when you retain the expert to testify at trial.

We are obligated to provide the expert’s credentials including where they went to medical school, where they did their medical training, what state they are licensed in and whether they are board-certified.

In addition, we must also describe the substance of expert testimony the expert will be giving at trial.

The one thing we are not required to provide is the medical expert’s name.

The reason we need not provide the experts name is that there is a risk of intimidation by the defense insurance company as well as their peers. Ironically, this turns out to be a moot point since practically every lawyer in New York has access to the same software that allows you to identify an expert simply by plugging in their medical credentials.

Cross-exmination is all about exerting control over the witness. A talkative medical expert has been taught and counseled to try and explain his answers at every opportunity. This could be very troublesome for a novice attorney.

The key to a good cross exam is never to give control to the witness. If you do, you will have lost a valuable opportunity to control the witness.

The best way to do that is by using short leading questions. That will severely limit the witness’ ability to explain.

You are sitting in the emergency room with severe groin pains. You’ve never experienced this type of pain before. It has not gone away. You are uncomfortable in every position; sitting, standing or lying down. You go to the emergency room and explain this has been going on for the last few hours. You hear some doctor mention that you might have testicular torsion and you begin to worry.

Testicular torsion occurs when the testicle twists. When it twists, it can cut off the blood supply and cause excruciating pain. When that happens there is a limited window of opportunity in order to correct and fix that problem.

A number of years ago I represented a young boy who had this exact problem. His parents took him to the emergency room for help. That’s where the problem started. The doctors initially did not think he had a torsion and there was no sense of urgency associated with evaluating him. There were no surgeons available in-house, and by the time a qualified pediatric surgeon arrived and imaging and flow studies were done, the blood flow to his testicle had been cut off. The only option at that point was to go in and surgically remove the testicle.

Although they were told that the child’s fertility would likely not be impacted, there was still a chance that he would have difficulty conceiving when he got older. The parents were distressed to learn that there was only a short window of opportunity within which to recognize, diagnose and treat this.

When our experts reviewed the medical records, they confirmed that there were departures from good and accepted care that delayed this child receiving appropriate and timely treatment that would have saved his testicle.

I created a video about the problem this family faced and posted it on YouTube. This particular video consistently gets comments from family members and men who have had this experience.

The goal with all of my videos is to educate my consumers and potential clients so they have information that will help them choose what the next step should be.

A man fractured his arm at work and the emergency room put a cast on and told him to follow-up in the orthopedic clinic. For seven weeks he continued to follow up as instructed and when the doctors removed the cast his arm looked like a roller coaster.

He asked the doctor who removed the cast “Why does my arm look like that?” The doctor replied that with a little massage and physical therapy it would be back to normal in no time.

This simply made no sense to the patient.

He went to an orthopedic surgeon and brought copies of his x-rays with him. The orthopedic surgeon determined that the reason the patient’s arm looked so bizarre was because the patient’s arm was never properly set and reduced to begin with. When a bone is broken, it is often necessary to put the pieces of the bone back together into correct alignment and positioning. This is known as “reducing the fracture.”

If the doctors are able to do it without surgery, this is known as closed reduction. If proper alignment cannot be done through manipulation and traction of the two bones, then the patient must be taken to the operating room to perform surgery to get the bones into proper alignment and positioning. If surgery is needed, it is necessary to use hardware, usually titanium screws, pins, wires and rods to hold the bone fragments in place.

The orthopedic surgeon had the difficult task of telling the patient that in order to fix the problem, he now needed to re-break the bone and would require surgery to properly position the bones together and they would be connected with titanium rods and screws. The patient would now have a significant surgical scar and would likely suffer decreased range of motion and limitation of use of his arm.
If the doctors had set the bone correctly, the patient would never have needed corrective surgery with hardware.

Who would’ve thought that a patient going for dialysis every other day would wind up bleeding to death on his bathroom floor?

A woman returned from lunch one day, opened her front door and found blood spatter by the front door and continued every few feet into the house leading her directly to the bathroom toward the back of the house on the main floor. She never expected to find the gruesome scene before her.

She found her husband lying crumpled on the floor in the bathroom with blood all over the bathroom. Blood had shot up onto the ceiling, onto the walls, onto the floor, the mirror, the bandages and also the towels. Her husband was covered in a pool of blood.

When the police arrived, they thought the man had been murdered. Detectives determined however that this was not a crime scene. Instead, it was a case of a dialysis access, called a shunt, that had ruptured causing this man to lead to death within minutes.

An autopsy performed by the medical examiner of the city of New York revealed that there was a wound infection that caused his shunt to rupture. A shunt is a connection between the vein and the artery. If that opening is exposed, you will bleed out within minutes.

Our medical and surgical experts determined that the kidney dialysis center failed to timely recognize that this patient had a wound infection and failed to send the patient for immediate treatment. They failed to recognize that the shunt access was not intact which led to this man’s untimely death.
