    How do you differentiate between a poor outcome of a surgery vs. malpractice? For instance, a transplant surgeon performing a heart transplant and then the heart fails after a few months: arguably it could be due to poor surgical technique, implant rejection, etc. Are cases like these litigated? It seems to me it would be difficult to do so, given that no two patients are alike, and there is no way of knowing (excluding gross negligence) whether that particular surgeon made a sub-par performance — it’s not as though you can repeat the transplant with another surgeon and compare!

    That’s why you need a medical expert to differentiate between the two that you mentioned. A bad outcome does not necessarily mean there was wrongdoing. In NY, we are required to have a medical expert confirm there were departures from good care that resulted in significant injury.
